Batar Terms of Service
Effective date: 21 August 2026
These Terms of Service (the Terms) govern your access to and use of Batar’s website, mobile applications, messages, and related marketplace services (together, the Service). Please read them carefully. By creating an account, tapping “Continue”, using the Service, posting a listing, making an offer, unlocking a conversation, or buying Batar Credits, you agree to these Terms.
The Service is operated by BATAR TECHNOLOGIES LTD, RC No. 9749137, of 3, JERRY ALOCHA, AGO PALACE WAY, LAGOS STATE, NIGERIA (Batar, we, us, or our). If you do not agree to these Terms, do not use the Service.
1. What Batar does
Batar is a marketplace that helps people discover and discuss electronics listings and propose an outright purchase, an upgrade (your item plus cash, where applicable), a downgrade (the seller’s item plus cash, where applicable), or a direct swap. Sellers, including businesses, may post inventory. Buyers may submit structured offers and, when available, use Batar’s market-based estimate tools to understand a possible value range and possible cash difference.
Batar is not the seller or buyer of any listed item. We do not own, inspect, authenticate, repair, warrant, insure, store, deliver, collect, hold, transmit, or escrow the money or devices involved in a marketplace transaction. We are not an agent, broker, auctioneer, lender, or party to an agreement between marketplace users. Any agreement, inspection, payment, swap, delivery, transfer of ownership, return, warranty, or dispute about a listed item is solely between the relevant users.
2. Who may use Batar
You may use the Service only if you are at least 18 years old, can enter into a binding agreement under applicable law, and are legally permitted to use the Service. If you use the Service for a business, you confirm that you are authorised to bind that business to these Terms.
The Service is initially intended for users and transactions in Nigeria. You are responsible for complying with all laws that apply to you, your listings, your offers, and any transaction you arrange through the Service.
3. Your account and information
You must provide accurate, current, and complete account information and keep it updated. You are responsible for safeguarding your account, verification codes, device access, and all activity under your account. Do not share access to your account or use another person’s account without permission. Tell us promptly at support@batar.app if you suspect unauthorised access.
We may require reasonable verification or additional information to protect users, comply with law, investigate abuse, or operate the Service. You must not create accounts using false identities, misleading profile information, or another person’s email address or details without permission.
4. Listings, offers, and user responsibilities
Each seller is responsible for every listing, photograph, video, description, condition statement, price, accepted offer type, availability statement, and other information they provide. Listings must be truthful, clear, current, and not misleading. Sellers must have the legal right to offer the item and must disclose material faults, alterations, carrier locks, repair history, replaced parts, missing accessories, account locks, or other information that could reasonably affect a buyer’s decision.
Each buyer is responsible for reviewing a listing, asking questions, inspecting any device and its identifiers before payment or exchange, and deciding whether to make or accept an offer. An offer, conversation, message, estimate, listing, review, or notification does not require either user to complete a transaction unless the users separately agree to binding terms between themselves.
For an outright purchase, the buyer and seller decide the payment and delivery terms themselves. For an upgrade, downgrade, or direct swap, the users must agree themselves on the items involved, their actual condition, the cash difference (if any), how ownership will transfer, and the time and place of exchange. The cash amount shown in an offer or conversation may be a proposal only and may change only by agreement of the users. Batar does not receive or hold that cash or either item.
5. Safe trading
Meeting, inspection, payment, delivery, collection, and exchange are at your own risk. Use good judgment. Meet in a safe, public, well-lit location where practical; take a trusted person with you if appropriate; inspect the actual device before handing over money or property; and keep records of what you agree. Do not send money, release your device, share financial information, or rely on a payment confirmation until you are satisfied that it is genuine and the agreed exchange is ready to happen.
Batar does not conduct a background check on every user and does not guarantee a user’s identity, reliability, ownership of an item, payment ability, or intention to complete a transaction. Reviews and ratings reflect users’ opinions and are not endorsements or guarantees by Batar. If you believe there is an immediate danger, fraud, theft, or other crime, contact the relevant emergency services or law-enforcement authority.
6. Prohibited items and conduct
You must not use the Service to list, offer, request, advertise, arrange, or facilitate anything unlawful, unsafe, fraudulent, deceptive, or infringing. In particular, you must not list or offer:
stolen, counterfeit, cloned, unlawfully imported, recalled, prohibited, or otherwise illegal items;
devices that you do not own or have authority to sell or exchange;
items with false, altered, or concealed serial numbers, IMEI numbers, ownership information, condition, specifications, or defects;
weapons, illegal drugs, adult or sexually exploitative material, financial products, regulated services, or any item outside the categories we allow; or
items that infringe another person’s intellectual-property, privacy, publicity, or other rights.
You must not scam, impersonate another person, manipulate prices or reviews, send spam, harass or threaten anyone, post hateful, obscene, or defamatory content, collect user information without permission, introduce malware, bypass security, interfere with the Service, scrape the Service without our written permission, or use the Service for money laundering, fraud, or any other unlawful activity.
7. Moderation, reports, and enforcement
We may review listings and other content, and we may use automated and human checks to help enforce our policies. We may approve, reject, hide, remove, limit, or edit the visibility of content; restrict features; close conversations; suspend or terminate accounts; preserve information; or cooperate with law enforcement where we reasonably consider it necessary. Moderation is not a guarantee that a listing, user, or transaction is safe, lawful, authentic, or suitable.
You can report a listing through the reporting tools in the Service. Reports should be made honestly and in good faith. We may consider a report, but we are not required to resolve a dispute between users or take any particular action. Do not submit knowingly false or abusive reports.
8. Market estimates and other information
Market values, estimated resale values, suggested cash additions, offer estimates, product information, search results, and similar information in the Service are provided for general guidance only. They may be based on available market information, assumptions, product configuration, stated condition, location, or other factors, and may be unavailable, incomplete, outdated, or incorrect.
These tools are not a professional valuation, appraisal, inspection, quote, purchase offer, financial advice, or guarantee of the price at which an item can be bought, sold, or exchanged. You remain responsible for your own inspection, research, negotiation, and decision. Batar does not guarantee the accuracy of any estimate or that a user will accept an offer, pay a particular amount, or complete a transaction.
9. Batar Credits and payments
Batar Credits are digital, account-based credits that may be used only for the feature shown at the time of purchase. Under the current Service, a seller may use Batar Credits to unlock messaging for an eligible pending offer conversation. Creating an offer does not require Batar Credits, and Batar Credits do not purchase a device, pay a user, guarantee an offer, increase a listing’s value, or create an ownership interest in any item.
Available credit packages, prices, currency, and the number of credits are displayed before checkout. We may change future packages or prices, but a completed purchase is governed by the package shown at checkout. Payments for Batar Credits are processed through Paystack’s hosted checkout. By choosing to pay, you also agree to provide accurate payment information and to Paystack’s applicable terms and privacy notices. Batar does not receive or hold payments for device purchases, swaps, delivery, or other marketplace transactions.
Except where required by applicable law or where we expressly approve a refund, Batar Credits are non-refundable, non-transferable, have no cash value, and may not be sold, exchanged, gifted, or redeemed for cash. We may reverse, cancel, or adjust credits if a payment is refunded, reversed, charged back, unauthorised, fraudulent, made in error, or otherwise invalid. A reversal may reduce your available credit balance, including below zero where permitted by law. Contact support@batar.app about a Batar Credit payment issue before seeking any external chargeback, where possible.
10. Content and intellectual property
You retain ownership of content you submit to the Service, such as listing descriptions, photos, videos, messages, and reviews. You grant Batar a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical formatting, display, distribute, and use that content only as needed to operate, improve, protect, promote, and provide the Service. You confirm that you have the rights and permissions needed to grant this licence and that your content does not violate these Terms or another person’s rights.
Batar and its logos, software, design, text, and other Service materials are owned by or licensed to Batar and are protected by applicable law. Except for the limited right to use the Service under these Terms, we do not grant you any rights in them. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except where applicable law does not allow that restriction.
11. Privacy
Our Privacy Policy explains how we collect, use, retain, share, and protect personal data when you use the Service, and forms part of these Terms. By using the Service, you acknowledge that your personal data will be handled as described in the Privacy Policy. You must use any personal information you receive from another user only for the relevant marketplace interaction and in accordance with applicable data-protection law.
12. Service changes and availability
We may change, suspend, remove, or discontinue any part of the Service, including listings, features, credit packages, estimates, or supported offer types, at any time where reasonably necessary. We will try to give notice of material changes where practicable, but we do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. Batar does not make a warranty or representation about any marketplace user, listing, item, content, review, market estimate, payment made directly between users, or transaction arranged through the Service. We do not guarantee that an item is genuine, safe, lawful, available, accurately described, free from defects, or suitable for your purpose, or that any user will pay, deliver, exchange, or perform as promised.
Nothing in these Terms excludes or limits a right, remedy, warranty, or liability that cannot lawfully be excluded or limited, including any applicable consumer-protection rights.
14. Limitation of liability
To the maximum extent permitted by law, Batar and its directors, officers, employees, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss; loss of profit, revenue, data, goodwill, opportunity, or anticipated savings; or loss arising from a marketplace user, listing, item, inspection, meeting, payment, exchange, delivery, return, dispute, fraud, theft, or your reliance on an estimate.
To the maximum extent permitted by law, Batar’s total liability for all claims arising out of or relating to the Service will not exceed the amount you paid to Batar for Batar Credits in the one month before the event giving rise to the claim. This limitation does not apply to liability that cannot legally be limited or excluded.
15. Your responsibility to Batar
To the maximum extent permitted by law, you will indemnify and hold harmless Batar and its directors, officers, employees, agents, affiliates, and service providers from claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising out of your content, listing, offer, transaction, use of the Service, breach of these Terms, or violation of another person’s rights or applicable law.
16. Ending use of the Service
You may stop using the Service at any time. You may request account deletion through the available account controls or by contacting support@batar.app. Ending your account does not remove obligations or liabilities that arose before it ended, and it does not require Batar to remove records we must or may lawfully retain for security, fraud prevention, accounting, dispute handling, or legal compliance.
17. Changes to these Terms
We may update these Terms from time to time. We will post the new version in the Service and update its effective date. If a change is material, we will provide additional notice where reasonably practicable. The updated Terms apply from their effective date. Your continued use of the Service after that date means that you accept the updated Terms. If you do not agree, you must stop using the Service.
18. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Before starting a formal claim, please contact us at support@batar.app and give us a reasonable opportunity to try to resolve the issue. Subject to any rights you have under applicable law, the courts of Lagos State, Nigeria will have exclusive jurisdiction over a dispute arising from these Terms or the Service.
Nothing in this section prevents either party from seeking urgent interim relief from a court with proper jurisdiction or limits a consumer’s right to make a complaint to a competent regulator or authority.
19. General terms
These Terms, together with the Privacy Policy and any terms shown to you for a specific feature or purchase, form the agreement between you and Batar about the Service. If a provision is invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a merger, acquisition, restructuring, or sale of assets, subject to applicable law.
